INTERNATIONAL CENTRE FOR ALTERNATIVE
DISPUTES RESOLUTION
The International Centre for Alternative
Disputes Resolution (ICADR) received 13 arbitration cases during
the period from March 1997 to March 2002, out of which five cases
have been resolved. The Centre received two conciliation cases
during that period, which too were resolved.
The ICADR, constituted by the Ministry
of Law and Justice, is designed to implement the scheme of arbitration
and Alternative Disputes Resolution (ADR) contained in the Arbitration
and Conciliation Act, 1996.
The ICADR established its first Regional
Office in Hyderabad in 1998. The second Regional Office in Bangalore
was inaugurated on August 31, 2002 by the Union Minister of Law
and Justice Shri K. Jana Krishnamurthi.
The Centre , apart from holding seminars
and workshops from time to time to train Arbitrators and Conciliators,
its Regional office in Hyderabad and the Centre in New Delhi are
also conducting Post Graduate Diploma Courses in ADR to train
new Arbitrators and Conciliators to enable courts to utilize their
services while referring cases for arbitration, conciliation or
to Lok Adalats under new Section 89 of the Code of Criminal Procedure,
1908.
The ICADR has been set up to promote
studies in ADR and allied matters and to promote reforms in the
system of settlement of disputes. The other functions of the Centre
relate to teaching and dissemination of knowledge of laws and
procedures on ADR, awarding diplomas and certificates. It also
provides training in ADR to those who are handling arbitration,
conciliation and mediation. Besides, it promotes research and
documentation in ADR and publishes books, periodicals and other
literature on the subject. It also organizes conferences, seminars,
conducts studies groups. It also provides logistic support for
holding conciliation, mediation, mini-trial and arbitration proceedings,
besides, maintaining panels of competent arbitrators and conciliators.
It also draws up rules for different modes of ADR.
