DISPOSAL OF PENDING CASES IN HIGH COURTS
A total of 36,40,870
cases are pending in various High Courts in the country as on
date.
The Government has
requested the Chief Justices of the High Courts to implement the
recommendations of the Malimath Committee to streamline procedure
which will expedite disposal of pending cases. Speedy disposal
of cases is within the exclusive domain of the High Courts. However,
both the Government and the judiciary are concerned with pendency
of cases in the judiciary including pendency of cases in the High
Courts.
he Malimath Committee
has recommended that rate of disposal of main cases per judge,
per year should be 800. However, as per the latest figures, the
estimated national rate of disposal per judge per year in the
High Courts is 1745 cases, calculated on the basis of the formula,
suggested by the Malimath Committee.
As per the latest
available information, the Madras High Court disposed of the highest
number of cases and the Sikkim High Court the lowest number of
cases during 2001-2002.
The reasons for disposal
of a low number of cases relates to substantive functioning of
judiciary. However, the Sikkim High Court has the lowest institution
and the lowest pendency of cases. The disposal of cases, therefore,
is the lowest in the Sikkim High Court.
