LAW COMMISSION
TAKES UP STUDY OF JUDICIAL ARREAR
The Sixteenth Law
Commission of India, headed by Shri Justice M. Jagannadha Rao,
has taken up a study of judicial arrears. This will explore how
effectively collection of judicial statistics will be useful to
policy makers in understanding the problem better apart from suggesting
steps for reducing backlog of cases and expediting disposal of
cases in general.
With the advent of
internet and information technology, legal research has assumed
great importance as collection of data hitherto impossible has
become possible.
Meanwhile, the Law
Commission has forwarded 182 Reports to the Government, out of
which 176 Reports have been laid in the Parliament. Six Reports
are yet to be laid in Parliament.
The Government has,
so far, implemented 97 Reports of the Commission. Thirty-nine
Reports are pending implementation or consideration. Forty Reports
have not been accepted and these require no further action.
The Law Commission
Reports are primary sources of law for the Parliament as well
as to the judiciary. Such reports have been used extensively to
interpret the provisions of the Acts by the Supreme Court of India
and the various High Courts. The Law Commission Reports have played
a crucial role in shaping the course of Parliamentary legislation.
