NATIONAL JUDICIAL COMMISSION


The Government is committed to setting up of a National Judicial Commission to make recommendations for judicial appointments in the Supreme Court and High Courts. The proposed Commission will draw up a Code of Ethics for judges besides ordering transfers, postings and promotion of judges. It will also take disciplinary action against judges indulging in malpractice.

There is already a broad national consensus about the setting up of a National Judicial Commission. However, there are some matters which have to be discussed for arriving at a broad consensus especially in the matters of composition of the proposed Commission.

The National Commission to Review the Working of the Constitution, which conducted a debate all over the country, has also recommended creation of a National Judicial Commission. The Government is examining the recommendations. This would, however, require an amendment to the Constitution of India.

One of the items of the National Agenda for Governance is to set up a National Judicial Commission.
