The Delhi Vidhan
Sabha passed a resolution on 18th July, 2002 recommending
transfer of the Delhi Development Authority to Delhi Government
with immediate effect.
By virtue of
specific provision under Article 239 AA, 3a entries 1,2 and 18
of the Sate List and entry 64,65 and 66 of Concurrent List, in
so far as they relate to entries 1,2 and 18 have been reserved
for Government of India with respect to Delhi. Entry 18 deals
with subject of land, therefore, Government of NCT of Delhi is
not competent to legislate on matters relating to land. Keeping
this Constitutional provision in view and that the Delhi Development
Act, 1957 which deals with planning and development of land in
Delhi. tHe administration of the Act and control of DDA will continue
with the Government of India and the Resolution passed by the
Delhi Assembly cannot be accepted.

and Poverty Alleviation, in a written reply to a question in the
Lok Sabha today.
