AMENDMENT IN THE INDIAN EVIDENCE ACT

The Government has proposed to amend the Indian Evidence Act, 1872 to make it more friendly to women.

A proviso to section 146 in the Indian Evidence Act, 1872 is proposed to be inserted to the effect that in a prosecution for rape and attempt to commit rape, it shall not be permissible to put questions in the cross-examination of the prosecutrix as to her general immoral character. Further, Clause (4) of Section 155, which provides that when a man is prosecuted for rape or an attempt to ravish, it may be shown that the prosecutrix was of generally immoral character is proposed to be omitted.

A Bill on the above lines has already been introduced in the Lok Sabha on November 28, 2002.

The proposed amendment is in keeping with the recommendations of the Law Commission and the National Commission for Women.
