DoT TO SEEK LEGAL OPINION ON TDSAT ORDERS


The Government is studying the Telecom Dispute Settlement & Appellate Tribunal (TDSAT)’s Order asking Department of Telecom (DoT) to submit correspondence between the DoT and the Telecom Regulatory Authority of India (TRAI) which led to the decision of allowing basic operators to offer limited mobility services. Saying that larger issues are involved, the Communications, IT and Disinvestment Minister, Shri Arun Shourie said that a considered opinion will be formed after consultation with the Law Minister, the Solicitor General and the Department of Telecom.

Replying to a question, he said that the Government is willing to place all papers including internal notings before the Tribunal. However, the Government has reservation of showing these internal notings to the business rivals. Mr. Shourie said that even in the Freedom to Information Act which is yet to be notified, the internal notings have been excluded. Replying to another question, he denied a newspaper report that DoT has cleared SMS for limited mobility.
