NOTIFICATION FOR ENFORCING INDIAN DIVORCE (AMENDMENT) ACT, 2001

   The Government in the Legislative Department has issued a Notification under Sub-Section (2) of Section 1 of the Indian Divorce (Amendment) Act, 2001, enforcing the Act with effect from October 3, 2001.

    The Indian Divorce (Amendment) Act, 2001, which was passed during the Monsoon Session of Parliament ending August 31, 2001, amends the Indian Divorce Act, 1869, dispenses with obsolete, antiquated and gender bias against Christian women vis-à-vis their men and brings about uniformity in application of Sections 10,17 and 20 to the entire Christian Community all over the Country by amending these provisions. It also removes hardships to the Christian women on account of gender inequality and to the estranged spouses on account of the need to obtain confirmation of the concerned High Court for giving effect to divorce decree or decree annulling the marriage.

    The Indian Divorce (Amendment) Act, 2001 also repeals three British statutes relating to Christian Personal Law as in force in India, which have become obsolete and as per the recommendations of P.C.Jain Commission on Review of Administrative Laws.
