INDIAN OFFICIAL ELECTED CHAIRMAN OF CATA MANAGEMENT COMMITTEE
Shri A. N. Prasad, Joint Secretary in the Central Board of Direct Taxes has been elected Chairman of the Management Committee of Commonwealth Association of Tax Administrators (CATA), for a period of three years. He takes over from Mrs. Feddy Mwerinde of Uganda.
The 21st Technical Conference of CATA was inaugurated by the Union Finance Minister, Shri Yashwant Sinha, here yesterday. The 5-day conference which will continue till 1st December is being attended by 70 delegates from 31 Commonwealth countries. The topics selected for detailed discussions during the Conference are "Harmful Tax Competition and Money Laundering" and "Reform and Modernisation of Tax Administration in the New Millennium".

FICCI CONFERENCE ON ANTI-DUMPING
The government is in the process of further strengthening the Anti-Dumping Cell under the Ministry of Commerce and Industry and building a synergy with the Safeguards Cell of the Ministry of Finance. Stating this at the inaugural session of the Conference on "Anti-Dumping: An Indian Perspective" organised by the Federation of Indian Chambers of Commerce & Industry (FICCI), here today, Shri Omar Abdullah, Minister of State for Commerce & Industry, reiterated the government's commitment to providing a level playing field to Indian manufacturers in regard to anti-dumping and safeguards and assured of the government's cooperation in protecting the interests of the Indian industry. He also said that the time taken by the Anti-dumping Directorate in recommending provisional and final measures against dumped imports compared favourably with those taken by the major trading countries, adding that efforts were being made to further reduce the time taken in arriving at anti-dumping findings. Shri Prabir Sengupta, Commerce Secretary, elaborated by stating that over the years anti-dumping actions by the government had been quite extensive, with India ranking second only to South Africa in anti-dumping initiations. As on date, out of the 77 cases initiated, in 67 cases hearing had already been completed. The time taken on anti-dumping action in the European Union (EU) was nine months, in Australia seven months and in India, four to six months, Shri Sengupta said, underlining the fact that anti-dumping action in India had not been more time consuming than in other countries. At the same time, Shri Sengupta stressed that improving competitiveness had to be a pre-requisite irrespective of the responsiveness of the anti-dumping mechanism. Emphasis on registration of products for compliance of BIS standards and application of Packaged Commodities Act was essentially on the premise that what was applicable to Indian players under the WTO rules should equally apply to other players, he said.
Emphasising that post-2005, India would be entering a new era with trade barriers coming down drastically, Shri Abdullah said that the government was trying to catalyse the process of transforming the Indian industry to face the world by focussing more and more on core competence and competitiveness. "Issues like increasing operational efficiency, cost reduction, safety, health, environment and waste management are of immense importance. It is essential that as a nation we need to encash on every possible opportunity of gaining competitiveness", the Minister said. Shri Abdullah also indicated that India has submitted several proposals to the WTO to improve implementation of the WTO Agreements on Anti-dumping and on Subsidies and Countervailing Measures by removing the existing imbalances so as to create a level playing field for the domestic industry. Referring to problems facing exports from India which had attracted frequent anti-dumping duties particularly in the EU -- with the number of such cases estimated to be more than 50 in the last 5 years -- Shri Abdullah said that wherever such investigations were found to be unfair, India had approached the Dispute Settlement Body of WTO for a judicial review. It was a matter of great concern for the government, he said, that a legislation had been enacted by a major trading country which called for distributing anti-dumping and countervailing duties levied on offending exporters to the domestic companies which had been hurt by unfair trade practices and informed that India had conveyed its serious concern on this issue to the WTO as such legislations could result in encouraging unfair trade practice petitions. He also said that the government was trying to devise a more efficient mechanism for information dissemination to enable Indian companies to fight their cases on stronger grounds.
Shri L.V. Saptharishi, Additional Secretary and DG in the Directorate of Anti-dumping and Allied Duties, Ministry of Commerce & Industry, said that the establishment of the WTO had brought in a new world trading order. The need for anti-dumping had increased in the wake of the removal of QRs and reduction of duties, he observed and added that there were a lot of operational and legal issues involved which needed to be understood and addressed in the anti-dumping mechanism of the government. Earlier, Shri R. V. Kanoria, Chairman, Foreign Trade Committee of FICCI made his welcome address and a theme presentation on anti-dumping which highlighted the industry's concerns regarding the issues to be considered for anti-dumping actions.

STEPS TO PROMOTE STEEL EXPORT The Government have decided to earmark Rs.5 crore for export promotion and market development in the Steel Sector. To boost exports of iron and steel, Ministry of Steel has set up a Steel Exporters Forum under the Chairmanship of Development Commissioner for Iron & Steel with major steel producers/associations as its members to remove bottlenecks in exports. Some of other measures taken by the Government to facilitate exports include full convertibility of export earnings at market rate of exchange, rationalisation of DEPB rates, facility available to exporters to import their requirements of raw materials duty free under the Advance Licensing Scheme.Exports of iron and steel, as per the existing policy are freely allowed. Exports of iron and steel and their destination depend on several factors such as domestic and international demand, domestic prices, prices in importing countries, etc. These factors are usually dynamic and change frequently. Based on the prevailing market conditions, enterprises themselves explore and tap the export markets.

Vizag Steel Plant of the Rastriya Ispat Nigam Ltd. (RINL), a Public Sector Undertaking of the Steel Ministry exported Rs.2.55 lakh tonnes of Steel worth Rs.203crore during the year 1999-2000. The Company exported 2.01 lakh tonnes worth Rs.179 crore during 1998-99. It exported Rs.3.93 lakh tonnes of Steel the previous year and earned Rs.370 crore.This information was given by the Minister of Steel Shri B.K.Tripathy in a written reply in the Rajya Sabha today.

NUMBER OF JUDGES IN CAPITALS LOWER COURTS
There were 5,78,389 cases/units pending in the Delhis subordinate courts as on January 1, 2000.
The number of judges in Delhi subordinate courts was increased by 33 in the month of June, 2000, raising its strength to 385. In the case of Delhi Bar Association versus Union of India and Others, the Central Government has submitted before the Supreme Court of India that out of these 385 posts, 248 are currently in position. If all the 385 posts are filled up, it would be able to take care of pending as well as current cases.

STRENGTH OF JUDGES IN GUWAHATI HIGH COURT
The Guwahati High Court caters to the needs of administration of Justice in all the seven North Eastern States.
The sanctioned strength of Guwahati High Court is 18 permanent /Additional Judges against the population of three crores thirteen lakhs eighty six thousand nine hundred and eleven as per 1991 census. Accordingly, per judge population of the North East is seventeen lakhs fortythree thousand seven hundred and seventeen as against the all India per judge population of fourteen lakhs sixteen thousnd six hundred and fiftyone.

During the last three years Central Government have allocated funds through National Legal Services Authority to various State Legal Services Authorities for meeting the cost of legal services in terms of the Legal Services Authorities Act, 1987.
The Central Government does not allocate any funds to the State. Funds are allocated by the National Legal Services Authority to the State Legal Services Authorities on receipt of detailed requirements. The State Authorities are required to utilise these funds for the purposes for which these have been sanctioned. If any State Authority is unable to utilise the amount of funds sanctioned to it in a particular financial year, then it seeks the approval of National Legal Services Authority for carry forward of the balance amount to the next year.
National Legal Services Authority, which is also called the Central Authority, has laid down policies and principles and framed various schemes for making legal services available under the Legal Services Authority Act, 1987. These schemes and policies are reviewed by the Central Authority from time to time and modifications wherever required are carried out.

GRADING SYSTEM MOOTED FOR EXAMS
The Central Board of Secondary Education (CBSE) has taken a decision, in principle, to issue subject wise grades without reference to marks in the class X examination. The proposed system of grading envisages declaration of results in terms of subject-wise grades instead of declaring the examinees pass or fail on the basis of fixed cut-off scores.
In order to implement the decision, discussions are being held by the CBSE and the NCERT with various schools, Teaching Community, Parents Representatives, Universities and other Boards. The CBSE currently follows a system of declaring examination results in terms of both marks and grades.

GOVERNMENT ASKED TO ENHANCE ALLOCATION FOR SCIENCE POPULARISATION
The Government has been asked to enhance the allocation for the national science popularisation programme. At its 9th meeting held here yesterday, the National Council for Science and Technology Communication (NCSTC) wanted more funds to create a lasting and far-reaching impact on the people in general about scientific achievements and their usefulness in raising the quality of life.
Echoing the sentiments expressed at the meeting the Minister of State for Science and Technology Shri Bachi Singh Rawat asked the Secretary, Department of Science and Technology Prof. V.S. Ramamurthy to explore all the possibilities of raising more funds for the programme. He said that unless we communicate the benefits of our scientific achievements right down to the grassroot level, the commonman will not benefit. In fact, science communication has to be reoriented in such way to ensure this, he said.
Shri Rawat commended the Council for successfully demonstrating the changes that can be brought about in improving the quality of life of the rural population, including women and the weaker sections of the society. The meeting decided to redouble its efforts to see that science popularisation and communication is effectively carried out to cover various segments of the society.
'39' PROCUREMENT OF MAIZE IN KARNATAKA Government of Karnataka will be procuring maize on the Minimum Support Price of Rs. 445 per quintal for distribution under PDS within the State. The difference between the economic cost and the issue price under PDS will be reimbursed by the Food Corporation of India as subsidy. This was decided when a delegation of Members of Parliament led by Shri S.M. Krishna, Chief Minister of Karnataka called on the Union Minister of Consumer Affairs, Food and Public Distribution, Shri Shanta Kumar and the Minister of State for Food and Consumer Affairs, Shri V. Sreenivasa Prasad here today. Karnataka is expecting a bumper production of maize this year and hence demanded that the quantitative ceiling in the export of maize to be removed.
Rice production in the State is expected to be touching 1.1 lakh tonnes this year and the procurement of rice by FCI will be through levy route from Karnataka; the Union Minister was informed.

CLOSURE OF MINES IN EASTERN COALFIELDS LTD.
The Board of Directors of Eastern Coalfields Ltd. (ECL) resolved to close down 64 coal mines located in the six areas of the company in its meeting held on November 22, 1998. This decision was taken based on financial problems being faced by the company for a long period and after considering in detail the evaluation made in respect of mines which could no longer be exploited economically. Accordingly, it was felt that a revival package, short of closure of mines and retrenchment of workmen would have better acceptance of the proposal by the employees. Pending finalisation of report by ICICI an interim plan was evolved in a meeting between the West Bengal Chief Minister and the then Minister of State for Coal in Calcutta the same year. On further discussions at various levels involving the Ministry of Coal, Coal India Ltd. and ECL a modified package was worked out but it was not accepted by the trade unions. Coal India Ltd. has engaged ICICI to study the working of all mines of Eastern Coalfields and to formulate plans for revival of the company. The final report of ICICI has been examined by the Ministry of Coal but no final shape to the revival package of ECL has so far been given for seeking approval of the Government.This information was given by the Minister of State for Coal, Shri N.T. The Prime Minister, Shri Atal Bihari Vajpayee visited Rajahumundry (A.P.) during May, 1999 and subsequently suggested the State Government to be in touch with the Ministry of Water Resources. Four projects referred to in the question for utilization of Godavari waters presumably are Ellampalli, Dummuguden, Inchampalli and Polavaram. The Project Reports for Ellampalli and Dummugudem have not been received in Central Water Commission (CWC) for techno-economic appraisal. For Polavaram and Inchampally projects, a High Level Committee has been constitued by the Government to resolve the inter-state issues.

FUNDS ALLOCATED TO ASSAM GOVERNMENT FOR FLOOD CONTROL
Union Ministry of Water Resources released an amount of Rs. 15.00 crore as Central loan assistance to the Government of Assam for flood control projects during 1999-2000. No funds have been released so far during the current year.
Out of Rs. 15.00 crore, the State Government of Assam has utilised Rs. 9.00 crore for implementation of flood control schemes during 1999-2000 and 2000-2001 (up to October, 2000).

The Central Ground Water Board (CGWB) and its 16 Regional Directorates located all over the country guide the State Governments in mitigating the problem of contamination of ground water. Chemical Laboratories of CGWB functioning in the Regional Directorates collect sample of ground water and after their analysis suggest necessary remedial measures to the State Governments. Besides, the Central Ground Water Authority (CGWA) also organises mass awareness programmes among general public and industrial workers regarding pollution of ground water.

STEPS TO PROTECT TRIBAL LANGUAGE AND CULTURE
The Government has evolved a number of strategies for the protection of tribal languages and tribal culture. These include creation of a separate Ministry of Tribal Affairs, provision of financial assistance to voluntary organisations and individuals for the protection of tribal arts, language and culture as also studies by universities on tribal culture on a regular basis. The Central Institute of Indian Languages, Mysore also undertakes extensive research in the area of 80 tribal languages. Various State Governments, too, have undertaken such projects.The universities that have undertaken projects on tribals are Ravi Shankar University, Raipur, North Eastern Hill University, Shillong; Ranchi University, Ranchi; Jharkhand; Annamalai University, Tamil Nadu; Deccan College, Pune; Arunachal University, Itanagar; Osmania University, Hyderabad; and Karnataka University, Dharwar.
In addition, Government organisations like the Anthropological Survey of India, Calcutta, the Language Division of the Registrar General of India, Calcutta; and also the National Council for Educational Research & Training, New Delhi, undertake programmes related to tribals.

JUSTICE MALIMATH COMMITTEE TO RECOMMEND MEASURES FOR REVAMPING THE CRIMINAL JUSTICE SYSTEM
The Ministry of Home Affairs, Government of India, have set up a Committee to consider measures for revamping the Criminal Justice System in the country. The Committee will examine the fundamental principles of criminal jurisprudence, including the Constitutional provisions relating thereto, and see if any modification or amendments are required thereto particularly whether there is a need to re-write the Code of Criminal Procedure, the Indian Penal Code and the Indian Evidence Act to bring them in tune with the demand of the times and to bring them in harmony with the aspirations of the people of India. The Committee is expected to make specific recommendations on simplifying judicial procedures and practices with a view to making the delivery of justice to the common man closer, faster, uncomplicated and inexpensive. The Committee will also suggest ways and means of developing such synergy among the judiciary, the prosecution and the police as restores the confidence of the common man in the criminal justice system by protecting the innocent and the victim and punishing unsparingly the guilty and the criminal.
One of the important terms of reference of the Committee is to suggest sound system of managing, on professional lines, the pendency of cases at investigation and trial stages and making the police, the prosecution and the judiciary accountable for delays in their respective domains. The Committee will also examine the feasibility of introducing the concept of "federal crime" which can be put on List 1 in the Seventh Schedule to the Constitution.
The Committee is chaired by Shri Justice V.S. Malimath, former Chief Justice of Karnataka/Kerala High Court. Other members of the Committee are Shri S. Vardhachari, former Adviser, Planning Commission and Shri Amitabh Gupta, former Director General of Police, Rajasthan, Shri Durgadas Gupta, Joint Secretary, Department of Justice, will act as the Secretary to the Committee.
The Committee will submit its report within six months from the date of its first sitting.

The Government is implementing various schemes under Border Area Development Programme for the development of these areas and to generate employment Youth from these areas are also recruited in Central para-military forces. In addition Village Defence Committees have been formed in Jammu & Kashmir comprising of volunteers from the villages. Special attention is being given to vital installations and regular inspection of industrial units is carried out for briefing the authorities on counter-measures. Inputs about threat perceptions emanating from various internal and external extremist/militant forces to the installations are shared with the State Governments/Central agencies & the management from time to time.

LOK SABHANEXUS BETWEEN DRUG SMUGGLERS AND SECESSIONISTS IN THE NORTH-EAST
There are reports of a nexus between drug smugglers and secessionist groups in the North-Eastern Region. A number of members of secessionist groups have been found to be in possession of drugs when arrested. The Government has reports that the Pak ISI has been helping the North Eastern militants/terrorists in purchase and transportation of arms consignments from abroad to the North-Eastern Region. The reports also indicate that the Pak ISI is providing assistance to North-Eastern militants in terms of money.
The Security Forces deployed along the borders have been alerted and are kept apprised about any reports of smuggling of arms and drugs. Narcotics Control Bureau has taken several steps in close coordination with the Governments of North-Eastern States for checking smuggling of drugs and the position is reviewed from time to time at various levels. Besides modernisation/upgradation of State Police Forces by grant of Central Financial assistance, information received from various sources is shared with the State Governments for taking appropriate steps for checking smuggling of arms and drugs.

PARLIAMENT PASSES WORKMENS COMPENSATION (AMENDMENT) BILL 2000
The Parliament has passed the Workmen Compensation (Amendment) Bill 2000. The Bill, which was earlier was passed by the Rajya Sabha on August 22, 2000, was approved by the Lok Sabha today. The Bill provides for increase in minimum compensation to the workers in case of death from Rs. 50,000 to Rs.80,000 /- and in case of permanent disability from Rs. 60,000 to Rs. 90,000 /- . Depending upon the age and wage of the worker or his dependents can get the maximum compensation upto Rs. 4.56 lakhs for death and Rs. 5.48 lakhs for disability . The funeral expenses have also been increased from Rs. 1,000 to Rs.2,500.The other salient feature of the Bill is that all workers have been brought within its ambit irrespective of their nature of employment. This is for the first time that contract labourers will be provided compensation for death or disability. Another striking feature of the Bill is that in case of delay in payment of compensation, both the interest and the penalty shall be paid to the workman or his dependent or as the case may be. Earlier only interest on the compensation amount was paid to the workers while penalty constituting upto 50% of the compensation amount paid by the employer, was credited to the government.
Replying to the debate, the Labour Minister Dr. Satyanarayan Jatiya described the Bill as a limited effort and said it is a beginning by the government for the welfare of workers. He said that the second National Labour Commission is looking into the framing of a comprehensive Bill for workers welfare. Dr. Jatiya said that Labour Ministry is also working on the Agricultural Labours Bill.
The Workmens Compensation Act, 1923 was last amended by Parliament in 1995.

ONGC TO UNDERTAKE EXPLORATION FOR OIL IN IRAQ
14TH INDO-IRAQ JOINT COMMISSION MEETS IN DELHI
ONGC-Videsh Limited (OVL), the wholly owned subsidiary of ONGC set up to carry out overseas exploration activities, is set to enter the oil exploration operations in Iraq. This has been facilitated with the signing of an exploration agreement between OVL and the Oil Exploration Company, Iraq, in the presence of Shri Ram Naik, Minister for Petroleum & Natural Gas and Dr. Amer Mohammed Rashid, Minister of Oil of the Republic of Iraq here today. The two Ministers co-chaired the Plenary Session of the 14th Indo-Iraq Joint Commission meeting.
While welcoming his counterpart from Iraq, Shri Ram Naik recalled the historic close relations between India and Iraq and the close cooperation that the two countries have had in economic, technical cultural fields based on mutuality of interests. He expressed India's concern at the continuation of UN sanction against Iraq and its humanitarian consequences and assured India's support for peace and stability in the Gulf region. On this occasion, Dr. Amer Mohammed Rashid brought out the vast opportunities that would be available in Iraq and expected the level of cooperation between India & Iraq would be further expanded. Responding to India's request for allocation of higher quantities of 'Crude Oil', he assured for favorable consideration. Currently India imports about 1.5 Million Metric Ton per annum of Basrah Light crude oil for its refineries.
The Minister further said that oil constituted a core sector of cooperation in the Indo-Iraq relations. He said that considerable progress has been achieved in economic, technical, industrial and cultural areas since the last Joint Commission meeting in Baghdad in July 1999. Iraq fully utilised all the slots allotted for training in technical fields, there were exchange of visits of specialists such as medical experts, engineers, agriculture scientists, etc. India also participated in Baghdad International Trade Fair in 1999 & 2000. The Minister also noted that the range of commodities traded has become more diverse with increase in quantity of tea sold to Iraq and that Iraq has placed an order worth $ 200 million on BHEL for turbines. Shri Ram Naik stated that there was immense potential for further progress in the untapped areas as presently India accounts for not more than 2.8 per cent of Iraq's import. The possibilities exist in areas such as health, industry, education, oil fields supplies, agriculture and the supplies of pharmaceuticals to Iraq.
The deliberation of the Joint Commission at the Official level are in progress and both sides expressed the hope that the outcome of the deliberations of the Joint Commission would substantially expand cooperation between the two countries by laying a framework for a strong multi-faceted relationship. The agreed minutes of the Joint Commission deliberations are scheduled to be signed by the two sides on 29th November, 2000 in the presence of Vice-President of Iraq and the Prime Minister.

DRINKING WATER FOR ALL RURAL HABITATIONS
Rural drinking water supply being a State subject, the schemes for supply of safe drinking water to the rural habitations of the country are implemented by the State Governments under the State sector Minimum Needs Programme (MNP). The Central Government supplements the efforts of the States by providing funds under the Accelerated Rural Water Supply Programme (ARWSP).
The National Agenda for Governance of the Government of India envisages provision of drinking water supply facilities to all rural habitations in five years, subject to availability of funds.
As the powers to plan, sanction and implement individual rural water supply schemes have been delegated to the State Governments, the schemes are sanctioned and implemented at the State level itself. The Government of India has sanctioned sector reform projects aimed to institutionalise community participation in rural water supply programme in 57 pilot districts since 1st April, 1999. The first instalment of funds in respect of 45 projects have been released to the State Governments/district implementing agencies towards the fag end of the financial year 1999-2000 and during the current financial year. The funds in respect of these projects are not released on annual allocation basis, but on the basis of achievement in terms of successful implementation of the project concept.
Reports have been received from the States of Madhya Pradesh, Chattisgarh, Rajasthan, Gujarat, Orissa regarding scarcity of drinking water due to deficient rainfall and lowering of ground water table. In view of the peculiar situation available in these States regarding scarcity of drinking water, the Government of India has decided to relax the priorities fixed in the Guidelines relating to the Accelerated Rural Water Supply Programme (ARWSP) to rejuvenation, renovation, restoration and replacement of existing rural drinking water supply schemes in areas affected by scarcity of drinking water in the above mentioned States. Further, the second instalment of ARWSP funds for the year 2000-2001 has been released to Gujarat and Rajasthan in relaxation of the requisite conditions.
